Yarg\u0131tay, kendi iste\u011fi ile i\u015f\u00e7i stat\u00fcs\u00fcnden s\u00f6zle\u015fmeli personel stat\u00fcs\u00fcne ge\u00e7en i\u015f\u00e7inin k\u0131dem ihbar tazminat\u0131 hak edemeyece\u011fine h\u00fckmetti.<\/h3>\n<\/header>\n<div class=\"content\">\n<p>Bir kamu kurumunda elektrik ustas\u0131 olarak y\u0131llarca \u00e7al\u0131\u015fan i\u015f\u00e7i, kendi talebiyle s\u00f6zle\u015fmeli personel stat\u00fcs\u00fcne ge\u00e7ti. \u0130\u015f Mahkemesi&#8217;ne m\u00fcracaat ederek k\u0131dem tazminat\u0131 talep eden i\u015f\u00e7i, i\u015f\u00e7i stat\u00fcs\u00fcnden memur stat\u00fcs\u00fcne ge\u00e7irildi\u011fi, istifas\u0131n\u0131n s\u00f6z konusu olmad\u0131\u011f\u0131n\u0131 dile getirdi.<\/p>\n<p>2013 tarihinde emekli oldu\u011funu, kendisine 29.06.1998-28.06.2013 tarihleri aras\u0131ndaki \u00e7al\u0131\u015ft\u0131\u011f\u0131 d\u00f6neme ili\u015fkin tazminat\u0131n\u0131n \u00f6dendi\u011fini ancak i\u015f\u00e7i olarak i\u015fe ba\u015flad\u0131\u011f\u0131 01.06.1975-28.06.1998 tarihleri aras\u0131nda i\u015f\u00e7ilikte ge\u00e7en s\u00fcreye ili\u015fkin \u00e7al\u0131\u015fmalar\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olan k\u0131dem tazminat\u0131n\u0131n \u00f6denmedi\u011fini \u00f6ne s\u00fcren i\u015f\u00e7i, k\u0131dem tazminat\u0131n\u0131n tahsilini talep etti. Daval\u0131 kurum ise davac\u0131n\u0131n kendi iste\u011fi ile stat\u00fcs\u00fcn\u00fc de\u011fi\u015ftirdi\u011fini, bu nedenle k\u0131dem tazminat\u0131na hak kazanamayaca\u011f\u0131n\u0131, talep hukuka uygun olsa dahi zamana\u015f\u0131m\u0131 s\u00fcresinin ge\u00e7ti\u011fini savunarak davan\u0131n reddine karar verilmesini istedi.<\/p>\n<p>\u0130\u015f Mahkemesi, i\u015f yerinde davac\u0131n\u0131n yaln\u0131zca stat\u00fcs\u00fcn\u00fcn de\u011fi\u015fti\u011fine, davac\u0131n\u0131n en son emeklilik nedeniyle i\u015f yerinden ayr\u0131ld\u0131\u011f\u0131na dikkat \u00e7ekti. K\u0131dem tazminat\u0131 alaca\u011f\u0131n\u0131n akdin sona erdi\u011fi tarihten itibaren 10 y\u0131ll\u0131k zaman a\u015f\u0131m\u0131 s\u00fcresine tabi oldu\u011funu belirten mahkeme, davac\u0131n\u0131n emekli oldu\u011fu tarihten itibaren 10 y\u0131ll\u0131k zaman a\u015f\u0131m\u0131 s\u00fcresinin dolmad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n kabul\u00fcne karar verdi.<\/p>\n<p>Yarg\u0131tay 22. Hukuk Dairesi karar\u0131 bozdu. Mahkeme ilk karar\u0131nda direnerek karar\u0131 Yarg\u0131tay 9. Hukuk Dairesi&#8217;ne g\u00f6nderdi. Emsal nitelikte bir karara imza atan Daire, i\u015f\u00e7inin kendi talebiyle stat\u00fcs\u00fcn\u00fcn de\u011fi\u015ftirdi\u011fine dikkat \u00e7ekti. Kararda \u015f\u00f6yle denildi:<\/p>\n<p>\u201cSomut olayda davac\u0131, daval\u0131 kurumda 01.06.1975-28.06.1998 tarihleri aras\u0131nda i\u015f\u00e7i stat\u00fcs\u00fcnde, 29.06.1998-28.06.2013 tarihleri aras\u0131nda ise s\u00f6zle\u015fmeli personel stat\u00fcs\u00fcnde \u00e7al\u0131\u015fm\u0131\u015ft\u0131r. 2.6.1997 tarihli dilek\u00e7e ile 1983 y\u0131l\u0131ndan beri sanatkar i\u015f\u00e7i olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, Meslek Y\u00fcksek Okulu Elektrik B\u00f6l\u00fcm\u00fc mezunu oldu\u011funu, i\u015fyerinde kalmak kayd\u0131 ile memur kadrosuna ge\u00e7mek istedi\u011fini belirtmi\u015ftir. Bu dilek\u00e7eden davac\u0131n\u0131n kendi iste\u011fi ile i\u015f\u00e7i stat\u00fcs\u00fcnden s\u00f6zle\u015fmeli personel stat\u00fcs\u00fcne ge\u00e7mek istedi\u011fi anla\u015f\u0131lmaktad\u0131r. Daval\u0131 idarenin ihtiya\u00e7 nedeniyle davac\u0131 dahil 78 i\u015f\u00e7iyi s\u00f6zle\u015fmeli personel stat\u00fcs\u00fcne ge\u00e7irmi\u015f olmas\u0131, stat\u00fc de\u011fi\u015fikli\u011finin davac\u0131n\u0131n iradesi ve istemi d\u0131\u015f\u0131nda ger\u00e7ekle\u015ftirildi\u011fini g\u00f6stermemektedir. Stat\u00fc de\u011fi\u015fikli\u011finin i\u015f\u00e7inin iradesine ba\u011fl\u0131 olarak ger\u00e7ekle\u015fti\u011fi, ayn\u0131 i\u015fyerinde \u00e7al\u0131\u015fmaya devam etmek ile birlikte i\u015f kanununa tabi i\u015f s\u00f6zle\u015fmesinin 28.06.1998 tarihinde i\u015f\u00e7inin iste\u011fi ile son buldu\u011fu, 29.06.1998 tarihinden itibaren idari mahiyetteki i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fmas\u0131n\u0131n devam etti\u011fi ortadad\u0131r. Bu nedenle i\u015f s\u00f6zle\u015fmesinin devrinden s\u00f6z edilemeyece\u011fi, kendi iste\u011fiyle i\u015f akdi son bulan i\u015f\u00e7inin k\u0131dem tazminat\u0131 isteme hakk\u0131 bulunmad\u0131\u011f\u0131n\u0131n kabul\u00fc gerekti\u011fi sonucuna var\u0131lmaktad\u0131r. A\u00e7\u0131klanan nedenlerle davan\u0131n reddi yerine kabul\u00fcne karar verilmesi hatal\u0131 olup bozmay\u0131 gerektirmi\u015ftir.
