Y\u00fcksek mahkeme, bu karar\u0131yla birlikte i\u015fverenlerin s\u0131k\u00e7a ba\u015fvurdu\u011fu \u2018denkle\u015ftirme izin form\u00fcl\u00fc\u2019ne dur dedi.<\/h3>\n<\/header>\n<div class=\"content\">\n<p>Bir fabrikada vardiya formeni olarak \u00e7al\u0131\u015fan i\u015f\u00e7i, resmi tatil \u00fccretlerinin \u00f6denmemesi sebebiyle i\u015f s\u00f6zle\u015fmesini tek tarafl\u0131 feshetti. \u0130\u015fverenden alacaklar\u0131n\u0131 tahsil edemeyen i\u015f\u00e7i, \u0130\u015f Mahkemesi&#8217;nin kap\u0131s\u0131n\u0131 \u00e7ald\u0131. Davac\u0131 i\u015f\u00e7i, milli ve dini bayram g\u00fcnlerindeki \u00e7al\u0131\u015fmalar\u0131na ili\u015fkin \u00fccretlerinin \u00f6denmemesi ve i\u015f s\u00f6zle\u015fmesi uyar\u0131nca yevmiye usul\u00fc \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u00e7in 31 g\u00fcn \u00e7eken aylarda 31 g\u00fcn \u00fczerinden \u00fccret \u00f6denmemesi sebebiyle istifa etti\u011fini dile getirdi.<\/p>\n<p>\u0130\u015f\u00e7i, k\u0131dem tazminat\u0131, dini, milli bayram resmi ve genel tatil \u00fccreti ile eksik \u00fccret alaca\u011f\u0131n\u0131n h\u00fck\u00fcm alt\u0131na al\u0131nmas\u0131n\u0131 talep etti. Daval\u0131 \u015firket sahibi ise i\u015f s\u00f6zle\u015fmesinde davac\u0131n\u0131n telafi \u00e7al\u0131\u015fmas\u0131 yapabilece\u011fi, ayr\u0131ca gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fcnde fazla \u00e7al\u0131\u015fma ve vardiyal\u0131 \u00e7al\u0131\u015fma yapmay\u0131 kabul etti\u011fine dair h\u00fck\u00fcm bulundu\u011funa dikkat \u00e7ekti.<\/p>\n<p>\u015eirket, davac\u0131n\u0131n eksik yevmiye \u00f6dendi\u011fine ili\u015fkin iddias\u0131n\u0131n yerinde olmad\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n bayrama rastlayan g\u00fcnlerde \u00e7al\u0131\u015fmas\u0131 halinde denkle\u015ftirme izni kulland\u0131\u011f\u0131n\u0131 veya bu \u00e7al\u0131\u015fmalar\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olan \u00fccretlerin \u00f6dendi\u011fini belirterek davan\u0131n reddinin gerekti\u011fini savundu.<\/p>\n<p>Mahkeme, davac\u0131n\u0131n ulusal bayram ve genel tatil \u00fccreti alaca\u011f\u0131n\u0131n bulunmad\u0131\u011f\u0131n\u0131 ancak eksik \u00fccret alaca\u011f\u0131na hak kazand\u0131\u011f\u0131n\u0131, b\u00f6ylece davac\u0131n\u0131n i\u015f s\u00f6zle\u015fmesini hakl\u0131 sebeple feshetti\u011fi sonucuna vararak, k\u0131dem tazminat\u0131 ile eksik \u00fccret alaca\u011f\u0131 talebinin kabul\u00fcne, ulusal bayram ve genel tatil \u00fccreti alaca\u011f\u0131 talebinin ise reddine karar verdi. Daval\u0131 \u015firket karar\u0131 istinafa g\u00f6t\u00fcrd\u00fc.<\/p>\n<p>B\u00f6lge Adliye Mahkemesi, davac\u0131n\u0131n 31 g\u00fcn \u00e7eken aylar i\u00e7in bir g\u00fcn eksik \u00fccret \u00f6dendi\u011fi sonucuna var\u0131lamayaca\u011f\u0131n\u0131, b\u00f6ylece davac\u0131n\u0131n eksik \u00fccret alaca\u011f\u0131 ve k\u0131dem tazminat\u0131na hak kazanamayaca\u011f\u0131 gerek\u00e7esi ile daval\u0131 vekilinin bu y\u00f6ndeki istinaf ba\u015fvurusunun kabul\u00fcne ve \u0130\u015f Mahkemesi karar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131na h\u00fckmetti. Karar\u0131 davac\u0131 i\u015f\u00e7inin avukat\u0131 temyiz edince devreye Yarg\u0131tay 9. Hukuk Dairesi girdi.<\/p>\n<p><strong>&#8220;\u0130\u015f\u00e7inin r\u0131zas\u0131 olmadan denkle\u015ftirme yap\u0131lamaz&#8221;<\/strong><\/p>\n<p>Emsal nitelikte bir karara imza atan Y\u00fcksek Mahkeme, i\u015f\u00e7inin resmi tatil izinlerini ba\u015fka g\u00fcnlerde kullanmaya zorlanmas\u0131n\u0131n yasal olmad\u0131\u011f\u0131na dikkat \u00e7ekti. Kararda kanunda ulusal bayram ve genel tatil g\u00fcnlerindeki \u00e7al\u0131\u015fmalar i\u00e7in herhangi bir denkle\u015ftirme kural\u0131na yer verilmedi\u011fi hat\u0131rlat\u0131ld\u0131. Fazla \u00e7al\u0131\u015fmada oldu\u011fu gibi serbest zaman verilmesine ili\u015fkin bir d\u00fczenlemeye de yer verilmedi\u011fi vurguland\u0131. \u0130\u015f\u00e7inin ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015faca\u011f\u0131n\u0131n i\u015f s\u00f6zle\u015fmesi ile kararla\u015ft\u0131r\u0131labilece\u011fi, ancak i\u015f\u00e7iden buna ili\u015fkin ayr\u0131ca muvafakat al\u0131nmas\u0131 gerekti\u011fi dile getirildi. Kararda \u015f\u00f6yle denildi:<\/p>\n<p>\u201cTaraflar\u0131n i\u015f\u00e7inin ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015faca\u011f\u0131na dair anla\u015fmalar\u0131 m\u00fcmk\u00fcn olup, bu \u00e7al\u0131\u015fman\u0131n kar\u015f\u0131l\u0131\u011f\u0131 da i\u015f\u00e7iye \u00e7al\u0131\u015ft\u0131\u011f\u0131 g\u00fcn\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 i\u00e7in ayr\u0131ca bir yevmiye tutar\u0131nda \u00fccret \u00f6denmesidir. Somut olayda ise, i\u015f\u00e7inin ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015ft\u0131\u011f\u0131 taraflar aras\u0131nda uyu\u015fmazl\u0131k konusu de\u011fildir. Daval\u0131 i\u015fveren dosyaya davac\u0131n\u0131n da imzas\u0131n\u0131 i\u00e7eren izin formlar\u0131 sunmu\u015f olup, bu izin formlar\u0131ndan davac\u0131ya \u00e7al\u0131\u015f\u0131lan ulusal bayram ve genel tatil g\u00fcnlerinin kar\u015f\u0131l\u0131\u011f\u0131nda izin kulland\u0131r\u0131ld\u0131\u011f\u0131 tespit edilmektedir. B\u00f6ylece davac\u0131ya ulusal bayram ve genel tatil \u00fccreti \u00f6denmemi\u015f, bunun yerine izin kulland\u0131r\u0131lm\u0131\u015ft\u0131r. Taraflar aras\u0131ndaki i\u015f s\u00f6zle\u015fmesinde davac\u0131n\u0131n bayram \u00e7al\u0131\u015fmalar\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131nda bir ba\u015fka g\u00fcn izin kullanaca\u011f\u0131na dair herhangi bir h\u00fck\u00fcm bulunmamaktad\u0131r. Davac\u0131, izin formlar\u0131nda izin kulland\u0131\u011f\u0131 belirtilen g\u00fcnlerin bir\u00e7o\u011funun hafta tatili g\u00fcn\u00fc oldu\u011funu belirterek, kendisine asl\u0131nda izin dahi kulland\u0131r\u0131lmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr. Ulusal bayram ve genel tatil g\u00fcnleri, dayan\u0131\u015fma, birlik ve beraberlik g\u00fcnleri olup, di\u011fer g\u00fcnlerden farkl\u0131 bir \u00f6zellik g\u00f6sterir. Bu g\u00fcnlerde bayramla\u015fma, sosyalle\u015fme, aile ve toplumun di\u011fer bireyleri ile birlikte zaman ge\u00e7irme gibi manevi birtak\u0131m ihtiya\u00e7lar\u0131n giderilmesi s\u00f6z konusudur. \u0130\u015f\u00e7inin a\u00e7\u0131k onay\u0131 olmad\u0131\u011f\u0131 s\u00fcrece ulusal bayram veya genel tatil g\u00fcn\u00fcnde \u00e7al\u0131\u015fman\u0131n di\u011fer herhangi bir g\u00fcnde \u00e7al\u0131\u015fmamak suretiyle telafisi m\u00fcmk\u00fcn g\u00f6r\u00fclmemelidir. T\u00fcm dosya kapsam\u0131nda i\u015fverenin ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015fan i\u015f\u00e7iye bu \u00e7al\u0131\u015fmas\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131n\u0131 \u00f6demek yerine izin kulland\u0131rd\u0131\u011f\u0131 ve davac\u0131n\u0131n da buna muvafakat etmedi\u011fi a\u00e7\u0131k oldu\u011funa g\u00f6re, izin kullan\u0131m\u0131 uygulamas\u0131n\u0131n ge\u00e7erli bir uygulama olarak kabul edilmesi m\u00fcmk\u00fcn de\u011fildir. Bu halde i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini hakl\u0131 sebeple feshetti\u011fi kabul edilmeli, buna g\u00f6re sonuca gidilmelidir. \u00d6denmeyen ulusal bayram ve genel tatil \u00fccreti alaca\u011f\u0131n\u0131n varl\u0131\u011f\u0131 kar\u015f\u0131s\u0131nda feshin hakl\u0131 sebebe dayand\u0131\u011f\u0131 kabul edilmeli ve davac\u0131n\u0131n k\u0131dem tazminat\u0131 alaca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nmal\u0131d\u0131r. \u0130\u015f Mahkemesi ve B\u00f6lge Adliye Mahkemesi&#8217;nce belirtilen y\u00f6nler g\u00f6zetilmeden k\u0131dem tazminat\u0131n\u0131n reddine dair yaz\u0131l\u0131 gerek\u00e7e ile h\u00fck\u00fcm kurulmas\u0131 hatal\u0131 olup, karar\u0131n bu sebeple bozulmas\u0131 gerekmi\u015ftir.
