Davan\u0131n k\u0131smen kabul edilmesi \u00fczerine temyiz edilen dosyay\u0131 g\u00f6r\u00fc\u015fen Yarg\u0131tay 6. Hukuk Dairesi, daval\u0131 \u00fcniversitenin s\u00f6zle\u015fmeye uygun olarak iki ay \u00f6nceden yaz\u0131l\u0131 bildirimle kira s\u00f6zle\u015fmesini feshetmesine dikkat \u00e7ekti.<\/p>\n<p>&nbsp;<\/p>\n<p>Ancak Yarg\u0131tay, fesih hukuki dahi olsa \u201canahtar tesliminin\u201d \u00f6nemini hat\u0131rlatt\u0131. Yerel mahkemenin karar\u0131n\u0131 davac\u0131 m\u00fclk sahibi lehine bozan Yarg\u0131tay, bu konuda kirac\u0131lar\u0131n y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc \u015fu \u015fekilde a\u00e7\u0131klad\u0131: \u201cDavac\u0131n\u0131n erken tahliyesi sebebiyle u\u011frad\u0131\u011f\u0131 zarar tazmin edilmi\u015f ise de bu yolla ula\u015f\u0131lan tarihin benimsenmesi i\u00e7in kiralanan\u0131n fiilen bo\u015falt\u0131lm\u0131\u015f ve anahtarlar\u0131n\u0131n kiralayana hukuki \u015fekilde teslim edilmi\u015f olmas\u0131 gerekir.<\/p>\n<p>&nbsp;<\/p>\n<p>Anahtar teslim edilmedi\u011fini b\u00f6ylece kira ili\u015fkisinin kendisince ileri s\u00fcrd\u00fc\u011f\u00fc tarihte hukuken sona erdirildi\u011fini ispatlama y\u00fck\u00fc kendisine ait olan kirac\u0131, anahtar teslimi hukuki bir olgu oldu\u011fundan bunu delillerle ispatlayabilir. Kiralanan\u0131n a\u00e7\u0131kland\u0131\u011f\u0131 \u015fekilde y\u00f6ntemine uygun bi\u00e7imde hangi tarihte tahliye edildi\u011fi belirlenerek sonucuna g\u00f6re karar verilmesi gerekir.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p><strong>&#8216;ANAHTARLAR VER\u0130LD\u0130&#8217; D\u0130YE \u0130SPAT \u015eART<\/strong><br \/>\nKira s\u00f6zle\u015fmesinin feshedilmesine ra\u011fmen anahtarlar\u0131 teslim etmeyen kirac\u0131, s\u00f6z konusu d\u00f6nemden sonra biriken aidat ve kiralar\u0131 ev veya i\u015f yeri sahibine \u00f6demek zorunda.
